Operator Terms

The core responsibilities of businesses listed on Diving.Voyage or accepting online bookings.

Scope

Diving.Voyage is operated by Marcel Lewandowski, a sole trader registered in Ireland under the business name Webase Global (business name number 675208), with a registered business address at 77 Camden Street Lower, Dublin, D02 XE80, Ireland ("Diving.Voyage", "Webase Global", "we", "us" or "our").

These terms apply to a business claiming, managing or publishing a listing or using Diving.Software to make services bookable. The accepting person confirms authority to bind it.

Eligibility

The Operator must be a genuine, lawfully operating business or professional permitted to provide the advertised service and must keep legal, ownership, tax, contact, location, bank and activity information accurate.

Responsibilities

  • Deliver services safely, lawfully and professionally.
  • Maintain permits, licences, insurance, qualified staff, equipment, vessels and emergency plans.
  • Set accurate prices, taxes, capacity, availability and prerequisites.
  • Make final participation and safety decisions.
  • Handle complaints, incidents, refunds and regulatory duties.

Listings and bookings

Descriptions, images, availability, prices and claims must be accurate. We may request evidence or unpublish misleading, unsafe or unlawful material.

The Operator is the contracting provider and must honour confirmed bookings, preserve frozen policies, and provide required pre-contract information.

Ranking, data and distribution

The main parameters and relative importance used for ranking are published in Ranking and Marketplace Transparency. Paid influence is labelled. We may display an Operator's identity and offers through Diving.Voyage and closely identified Webase Global channels; no undisclosed affiliate distribution programme currently applies.

During the relationship, the Operator can access the listing and organization-scoped operational data made available through its account. Platform security, aggregate analytics, other users' data and data we must retain are not transferred as Operator-owned data. Reasonable export requests may be submitted through Contact.

Data and reviews

The Operator is controller for service delivery, safety, documents, incidents and accounting. Voyage-supplied data may be used only for compatible purposes, with restricted staff access. Medical and emergency data must never be used for marketing.

The Operator must not create, buy, condition, suppress or manipulate reviews or ranking signals.

Platform integrity

An Operator must not initiate a Platform booking and then redirect the customer to an undisclosed off-platform payment to avoid recorded terms or fees. We may pause listings, bookings or payments where evidence is missing, expired, restricted, unsafe or creates material fraud or legal risk. An appeal route is available where appropriate.

Commercial and tax

Subscriptions, commission, taxes, processing costs and payout settings are stated in the versioned Commercial Schedule accepted in Diving.Software. Changes are prospective after at least 30 days' notice; confirmed bookings retain their fee version.

The Operator handles taxes and invoices for customer services and provides information reasonably required for payments, sanctions and DAC7 or similar reporting.

Business liability and indemnity

Nothing limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence. Subject to that rule, Webase Global is not responsible for the Operator's services, safety decisions, staff, equipment, content, taxes or regulatory duties.

To the extent caused by its breach, negligence, service, content or legal duties, the Operator will defend and indemnify Webase Global against third-party claims, chargebacks, penalties and reasonable costs relating to injury, property damage, intellectual property, tax or regulatory non-compliance. This does not apply to the extent caused by Webase Global. Subject to mandatory law and the exclusions above, Webase Global's aggregate B2B liability arising in any 12-month period is limited to the Platform fees paid or payable by that Operator during that period.

Restriction, termination and law

For restriction or suspension, we provide the main reason on a durable medium before or when it takes effect, unless law prevents this. For termination of the whole service, we normally give at least 30 days' notice and reasons. Immediate action may be taken where law requires it, serious safety or security risk exists, or repeated material breach makes continuation unreasonable. An Operator may clarify facts and appeal through Contact.

Irish law applies and B2B disputes are subject to Dublin courts, without limiting mandatory law. Use Contact first for good-faith resolution.

General

Neither party waives a right by delaying enforcement. If a provision is unenforceable, the remainder continues. The Operator may not transfer the agreement without prior written consent; Webase Global may transfer it with the business or service on notice, subject to applicable law.

These Operator Terms, the accepted Commercial Schedule, DPA and referenced policies form the agreement for the Platform service. They do not replace the separate contract between the Operator and each customer.
